District 6 Trustee Candidate RYAN DACK tags opponent James Wright for campaign finance violation

     Earlier today, I was contacted by SOCCCD trustee candidate (district 6) Ryan Dack, who apprised me of his efforts looking into the campaign finances of his opponent, James Wright. Dack asserts that Wright is in violation of campaign finance law, for he received a contribution of over $2,000 from the South Orange County Community College District Faculty Association (the district faculty union) sometime in July/August but never filed a form 460. 
     The filing of form 460 is required by state law and the Fair Political Practices Commission (FPPC) when a candidate receives a contribution of over $2,000. Wright only filed a form 470, which indicated that he would not raise over $2,000.

The Form 460 is for use by all recipient committees, including: Candidates, Officeholders and Their Controlled Committees. 
[This form is for]…A candidate or officeholder who has a controlled committee, or who has raised or spent or will raise or spend $2,000 or more during a calendar year in connection with election to office or holding office. The Form 460 is also required if $2,000 or more will be raised or spent during the calendar year at the behest of the officeholder or candidate. [See California Form 460
     Dack says he recognizes that this is no great shakes. Still, he believes “that our public servants should be transparent about where their money comes from.” He doesn’t believe that Wright’s violation was malicious. On the other hand, “at the very least we should expect competency from our elected officials when it comes to things like campaign finance.”
     According to Dack, at this point, Wright’s form 460 is over 80 days late and he’ll face a penalty.

I guess this is a question to the FA. Did you actually give Jim $2k?
Also, the FA can do things in support of a candidate where the candidate does not have to report it. If they send out a flyer (costing $2k) that says "Vote for Jim" and in small print it says not paid for by Jim that is ok.

Also, the reporting period for donations is weird. He still may be ok if the donation happened after he filed that document but we have not yet met the next reporting deadline.

And, if this was really a concern, Ryan should be reporting it to the FPPC, not an online blog.

When I first got into this race, I made sure to do everything by the book. Running against an incumbent, I had no idea what campaign I'd be running against. I was surprised to see NO filings for him when the first deadline passed in September.

After doing more digging, it was curious to me that Jemal and Inmon received donations from the FA (and indicated as much in public filings) amounting to $3982.78 (the exact cost of the candidate filing statement) and Wright had not. I did a lot more digging, and ran into a lot of dead ends looking for this information. I eventually found someone in the FA that told me they in fact donated over $2,000 to Wright during the summer.

Upon learning this information, I contacted the Campaign Finance officer at the Registrar of Voters. They got back to me today and indicated that the Wright campaign is in-fact in violation of campaign finance law, and failed to submit the two 460 Forms, in addition to a 497 Form.

The OC ROV is taking care of this issue for now, but I really expected more from our public servants. Wright ran a campaign in 2016 and filed the appropriate disclosures on time then. He should know better, so the question has to be asked: Why didn't he file these disclosures this year?

It’s not surprising our trustees aren’t aware of these kinds of rules. I think there is going to be a lot of turnover on the board. If not this year, it will happen beginning two years from now. They are all white and over 50. They no longer understand the electorate and have been getting by for far too long.

But Wright WAS/IS aware of the "rules" as he abided by them before.

I agree, the board is due for a turnover but I don't think the electorate of South OC cares as much s some of us do....

Jim has no excuse other than arrogance and old age.
