Adiós and hola!

HOLA. Life is good! The OC Reg reports (Case against H.B. Mayor Debbie Cook dismissed) that
Congressional candidate Debbie Cook has won a victory, after the Fourth District Court of Appeal dismissed a lawsuit that challenged her ballot designation as mayor of Huntington Beach...Republican leaders said they filed the lawsuit on the grounds that Cook, a Democrat, shouldn't be allowed to use the "Mayor" designation on the ground that the voters elected her to the City Council and not to the position of mayor.... Cook has said she followed the law. She called the suit an attempt to distract her from her campaign to unseat Republican Rep. Dana Rohrabacher, incumbent for the 46th Congressional District.
.....The lawyer for the Repubs? That would be Tom Fuentes' pal (and OC "Republican mafia" Godfather) Michael Schroeder. State GOP official Keith Carlson filed the suit. Carlson, who is on the IVC Foundation board, was the emcee at the November Fuentes fundraiser.
.....The Reg notes that "Three Republican candidates for Assembly had also indicated 'mayor' in their individual ballot designations and achieved the position in a similar manner as Cook, records show. Republican leaders had not filed suit against them."
.....That's because they're assholes.
.....Carlson and Co. were ordered to pay Cook's litigation costs.

By the weird logic of that lawsuit, Don Wagner can't call himself President of the Board of Trustees. After all, the voters didn't elect him to that; the other Board members did. So I hope he listens to his conscience and never allows people to refer to him as president again.

I've known Debbie Cook for about 18 years. She is absolutely honest, as well as smart, dedicated, hardworking and all those other things . . . . oh, yes, and mayor of Huntington Beach. What a desperate shot to take! Are they actually afraid of losing their 20-year hold on that "safe" district? I'd be happy to think so.

Their real problem with Debbie, though, is that she's not a right-wing wacko. She's a pro-environment L-word Democrat. And she lives in a Congressional District that's so jerrymandered it looks as though it was plotted pixel by pixel to touch every Republican and avoid every Democrat it could. How else to explain 20 years of Dana R?

Um...did anybody bother to read the opinion? There's nothing in there on the merits. The court ruled that the case has to be brought in Sacramento and the Secretary of State be made a party. Sorry, Chunky, but try as you might you can't fairly spin this as a big Repub defeat. The court was very solicitous of Carlson, going out of its way to accept his various standing arguments before dealing with the fatal Secretary of State issue.

And Allanah, what are you talking about? The weird logic is not in the lawsuit but in your analogy. This case has nothing to do with what Cook calls herself (or Don Wagner calls himself) other than on a ballot where specific rules apply. Come on. You should be better than that!

6:24, there's nothing in the Reg report on the "merits" since the case manifestly has no merit, which is why the court ordered Carlson to pay Cook's litigation costs.

The "Republican mafia" is desperate. Their boy Carona is disgraced; one of their own just got sent to prison for molesting boys; their pick for treasurer turned out to be both corrupt and possibly incompetent; and now it looks like Rohrabacher might go down in flames, like so many Republicans.

Schroeder and Carlson don't complain about the Republicans who call themselves "mayor." No, but they take this Dem to court, forcing her to pay for legal representation. That ain't easy; I've been there.

Admit it. These are unprincipled and desperate Rovian tactics. This defeat comes on the heals of similar defeats by this crowd. That's what makes it especially gratifying.

But go ahead. Defend manifestly corrupt bastards. You define yourself thereby.

Dear 6:24,

(1) Although I personally have no knowledge of how Debbie Cook is going to deal with this nonsense if it comes back, Mayor of Huntington Beach is Debbie's "principal" profession, vocation or occupation, and allowable under 13107 (3):
"No more than three words designating either the current principal professions, vocations, or occupations of the candidate, or
the principal professions, vocations, or occupations of the candidate during the calendar year immediately preceding the filing of nomination documents. For purposes of this section, all California geographical names shall be considered to be one word." The fulfillment of duties of the Mayor of Huntington Beach fits the description of "Principal" and "vocation" as defined in Ballot Designation Regulations 20714 (a) and (b). regarding Elections Code 13107.

(2) I wouldn't say the court was "solicitous" of Carlson. It certainly wasn't being "solicitous" when it pointed out, for example, that as a Republican Carlson wasn't even an elector in the contest the complaint was about. So yes I did read it, and I read it much more as an "even if you allow this, and this, and this, you still don't belong here" dismissal.
