Prayer suit demagogued; John Edwards criticized; plaintiffs tarred with "atheist" brush; Wayne Ward remembered

The "prayer" suit:

.....AS WE REPORTED two days ago, on Tuesday, Judge R. Gary Klausner denied Westphal, et alia’s motion for a preliminary injunction. It is something we had expected. Naturally, the denial of this motion is not a judgment of the suit.
.....Further, the “denial” can be appealed (no decision on that yet).
.....Further, Klausner’s remarks (issued on Tuesday) are hardly a vindication of the district, for Klausner seems to acknowledge the unconstitutionality of trustee Don Wagner’s infamous “scholarship” speech and Chancellor Raghu Mathur’s notorious opening session “Jesus” video:
The Court notes some of the specific conduct by Defendants may have violated the Constitution while some other conduct did not. For example, Trustee Wagner’s comments at the 2009 scholarship ceremony and the slide show at the 2009 Chancellor Opening Session may appear to be in violation of the Establishment Clause…. 
.....It is true that, as things stand, Klausner appears unsympathetic to the notion of a general ban on “offering prayer or religiously themed programming” at the district. But he has made no final ruling about our suit.

Dandy Don the Demagogue

.....Also as expected, Wagner immediately demagogued the situation, for, on Tuesday, he added the following to his “Wagner for Assembly” website:

The United States District Court has sided with Don Wagner and the South Orange County Community College District against the atheist plaintiffs in their misguided lawsuit challenging invocations at the college district. Wagner and the District have defeated the plaintiffs' request for a preliminary injunction and invocations can continue.

.....The plaintiffs, Americans United for Separation of Church and State [sic], sought an injunction but after months of discovery, including depositions from Wagner and other trustees, and reviewing thousands of pages of documents, the aetheists [sic] could not make their case that the District was violating the establishment clause of the Constitution. The court denied the motion and invocations can continue.
.....Well, again, contrary to what Mr. Roe implies, the case is by no means over. We plaintiffs have not prevailed in our motion for a preliminary injunction. That’s all. The case has not yet been decided, and, further, the judge’s decision about the injunction can be appealed.
.....Roe eventually acknowledges that
this case is not necessarily over. The aetheists [sic] may force this to trial and there is always a chance that Wagner et al could be defeated.

.....Well, again, the plaintiffs (i.e., Westphal, et al.) are not “atheists.” Some are atheists, but some are theists, some are agnostics, and I do believe we’ve even got a Deist in the bunch.
.....We do not object to prayer or religion. We embrace the Constitutional notion that our government, and thus our government officials, should not act to “establish” religion. In our opinion, the pattern of district actions in recent years amounts to establishment of religion.
.....Listen, when a government official (trustee) prays at commencement, he imposes his religion on the audience. He sets religiosity as the norm. Does anyone deny this?
.....Don loves to portray the situation as though we seek to prevent him and all other theists from praying. But no. As far as the plaintiffs of this suit are concerned, Don and others can pray all they want. They can climb on their roofs and pray into the cosmos or across the valley. They can swim in the ocean and pray there too. That’s all fine by us. (By me, anyway.)
.....But, says the Constitution, when someone acts as a government official, things are different. As a trustee of a community college district, he or she represents the government. And the government isn’t supposed to establish religion. Not in this country.
.....It ain’t rocket science.



Classified forum at IVC

.....Earlier today, a forum for classified employees was held at Irvine Valley College. The President, the VPI, and the VP of Student Services were present.
.....I’m told (by a reliable witness) that one employee—someone with a history of reliability (and of substantial service in the community)—stood up to make some critical remarks about IVC’s Director of Facilities, John Edwards.

.....(You’ll recall that, three or four years ago, complaints abounded concerning the alleged unprofessionalism and retaliatory nature of then-Director of Facilities and Maintenance, Wayne Ward. By the Spring of ‘07, he was let go, in part thanks to the high profile that objections to Wayne’s conduct and performance achieved here on DtB. See Two Days of Retaliation and It’s a condom,” he said.)

.....Here’s what I heard about today’s forum (again, from a reliable witness). According to Mr. Employee (I’ll call him “Em”), many classified are fearful of the Director, for, upon being approached, he at times becomes very angry: he transforms from Dr. Jekyll to Mr. Hyde.
.....Further (says Em), Edwards retaliates against those who would dare criticize him: people like Em (a natural leader who was instrumental in drawing attention to problems with Wayne Ward).
.....Recently, Em, who has long worked the day shift, was placed by Edwards on swing (night) shift, despite Em’s protests.
.....Evidently as illustration of Edwards’ temperament, Em cited an alleged incident last year in which Edwards, who was on campus to attend a play, accosted a teenager and held him or touched him. (Such conduct, says Em, is officious. The Director should have left the matter to the campus police.) The kid reacted to Edwards by hitting him in the face, resulting in an injury that kept the Director home for several days.
.....At one point recently, Em approached the college President, asking that he address these difficulties with Director Edwards. But, it seems, the President has responded by simply backing Edwards.

.....--Well, that’s what I’ve been told. Naturally, Edwards likely takes a different view of these matters. I do hope we’ll have the opportunity to present that. For what it’s worth, I’ve always found Edwards to be friendly and approachable. I’ve never seen this alleged dark side.
.....But I’m not a classified employee.
.....Stay tuned. No doubt we’ll hear more about this.

Didn't Edwards join the strange little chorus of administrators, managers, classified, and faculty who came to the board to sing Raghu Mathur's praises?
Didn't he go on about how Raghu allowed him to do something with, um, a storage container? Maybe it was a dumpster.
Maybe it's a military thing. You just say shit, if your boss says you say shit. You don't feel bad about it. You don't feel shame.

I remember when EM told me about what John was doing and how he came in on a Monday to find out he was no longer under Anthony Rodgers But Tony Sodoti he said well I'm sure this isn't the last time we will be switched and then later that day to find out he was going to swing shift his remark was something is up

Yeah I heard this meeting happened on Friday at 10am which was suppose to be a kind of platform where the classified were able to express their concerns and fears so I guess by how it sounds it got pretty interesting

It sounds like Mr. Edward's have some issues as a leader and surely have wronged Mr. Em. I feel that Mr. Em have every right to be on the first shift especially if he's doing his job. Mr. Em is well respected, and has high standards and should fight for what is right!

I spoke to Mr. Em personally and he told me the reason why he didn't want to do swing shift is because his food bank feeds up to 8,000 people a week from LA County to Riverside County, and this shift move would effect the way operations are ran. He had mentioned that to President Rouquemoore and he stilled agreed with John Edwards in shifting him to swing shift. It was reported that John Edwards donated $5.00 to his ministry. I commend Mr. Em for doing this type of work in the community which is really needed during this time of recession and hard times a lot a families are facing.

Edward's retaliation against Mr. EM: Mr. EM reported an incident involving a coworker chronically using profanity. Mr. EM is a devout Christian and was deeply offended, so for doing the right thing, he gets punished by having his whole life turned upside down.

One thing I do know about Mr. Em is that he will always speak up when someone in a high position takes advantage of workers and mistreats them. He told me before he didn't want to go through another Wayne Ward battle but John has left him no choice and now he is about to press 3 charges on John Edwards.

Mr. EM asked John Edwards why he was shifting him to swing shift when just earlier that morning he got an email from John saying he was being shifted under somebody else and all John Edwards said was (I'm trying something)

Get a grip. The only thing Edwards has done is turn this campus around. He took on a difficult position, loaded with problems, issues and misfits. He has gotten most of his staff working like professionals. However, he has more than one that still wants to do nothing more than argue, or in a position that they are not qualified to hold, or has some misguided sense of entitlement. Our bathrooms look the way they do because guys like EM spend most of their time finding ways not to do their jobs. Edwards is a class act. He's making the calls that every director before him would not make, could not make or was overwhelmed with the amount of energy needed to make appropriate changes. Leadership is what Edwards has brought to M&O. Some children don't like it when structure is brought to the playground. Some adults don't like it when they are held accountable for the job they were hired to do.

7:52 is right on the money. John has cleaned up this campus, made the buildings safer for everyone, and has tried to hold his crew accountable. He has streamlined many of the M&O processes and has improved response time greatly. Is he perfect? NO! Yes, he has a temper. But, try doing his job after being bombarded with nothing but complaints all day and a staff that quite often has it's own agenda. Not everyone, but enough to cause problems. The more he does, the more they/we want. What John needs is a capable Asst.Director or manager. AR was not the person, just a hinderance. Just go outside, take a look around, and tell me the campus is not better than before his tenure.

Wow a sympathizer for John I wondered how long it would TAKE for u to show up. Yes John has spent a lot of money on the campus but that is still no excuse for the way he offends people as you have omitted to that yourself with his anger issues it is unprofessional and should be addressed. You mentioned that Mr. Em doesn't do his job cleaning the rest rooms which means you must work for John Edwards which gets the readers to break down who u r. From what I understand their are 50 bathrooms on campus that Em. Had to make sure were stocked and cleaned all day plus his own assignment and getting called off of his assignments to go assist the BMW almost daiy how can a person do their job when their being called to help someone else that's sounds like a lot area to take care of. According to sources Mr.Em has thank you letter across campus including one from the president and John Edwards aas well about his performance well done on campus. No their has been injustice done here and I'm sure justice will prevail. Keep it coming sympathizers

It's not about being the next director of M&O (which I don't want, God bless you if I did). Nor is it about sympathy for Edwards. Edwards doesn't need sympathy, mine or yours. Edwards has taken the bull by the horn and the bull doesn't like it. What EM and the rest of the losers don't realize is that Edwards can play fuck around fuck with the best of 'em. And he's played with better than you. Once your union figures out that it is wiser to protect the position and not the individual, you're gone.

I happen to think that "Mr.Em" wasn't doing his job, and that's why he was reassigned...I know for a fact that the respectable "Mr. Em" spends more time running his food bank operation on his cell phone during hours that he should be taking care of his assigned duties as a classified employee. Although the volunteer work is honorable, perhaps he should step back and consider that SOCCCD isn't paying for him to run his food bank operation, they're paying him to work!

3:00 No, I'm not working next to "Mr.Em" but I've seen enough for myself to give my opinion, that's all...It's been numerous times that I've seen him either sweeping, mopping, or driving around while either talking on his famous bluetooth or fiddling around with his phone. And what if he is cleaning restrooms, buildings, helping, etc...isn't that his job, or is he volunteering at IVC as well?

As a classified employee I believe it is important to simply state the following and add no additional posts.

Each and every one of us have had issues and disagreements with our bosses. This is a reality in everyone's work life.

Most employees move on and recognize that it is part of the job. Some of us, carry our anger with us like a badge of honor and expose the badge to anyone in view or in earshot.

Ultimately, we are paid to do a job. Period.

The posts written here do not reflect the best in our classified staff. If there are issues with this manager or any manager or administrator, they need to handled through processes in place.

We are quite lucky folks. Individuals up and down the state are losing their jobs. We worry about a difficulty we are having with a boss--they worry about their next paycheck. We are just like them only much luckier since we have good jobs at this lovely college.

We are all professionals -- lets act like professionals.

You know I have read all the post and not responded since the Blog has reported what was said in the meeting on that Friday. You 4:11 have made some since you have spoken with wisdom and piece which is what I am commanded to do is live in piece. It would be great if it was that easy when I am told the reason why I'm being shifted is because I am trying something when people just like you said are losing jobs which affects their families. I am propelled to make sure they have food on their tables as we as classified are
also but one check away from losing our homes or having no food on our table and someday may have to run to a food bank just to eat. I don't know who u are but I can say that I have heard you

5:08 got it right. State employees are losing jobs. But that doesn't justify management acting the way Edwards treats certain employees. They get paid six figure salaries and should handle these situations in a more professional manner. Maybe Mr. Em was doing things he wasn't supposed to be doing but was he ever warned? I've heard people say things about Mr. Edwards attitude. Personally, he's okay in my book but I don't work for the man.

Not too long ago 95% of all custodians worked the night shift. "Em" was originally hired to work the night shift. The contract states:
7.3.2
The District shall give twenty (20) working days notice to affected employees before permantly altering their shift assignment or days off.
No reason is needed to why changing shift. Does not say management can't touch you if you are doing "God's work", doesn't matter, simple black and white language.

I don't think Mr.Em really agrees with the twenty day notice agreement with CSEA and the District at all for he has seen how it can disrupt peoples lives and can make it more challenging when you are shifted from one hour to the next. What Mr. Em is saying is if his hours are going to be affected and his food bank as well then give him a good reason and don't tell him (I'm trying something). Think about that 9:07 would that be a sufficient answer for you if your boss told you I'm going to change your hrs just out of the blue when you are doing something that may be beneficial to society or if you have a family. Once again listen with an open ear because the only people who would say yes to this is someone who doesn't have any responsibility or would rather stay away from home or is running from something because those hrs benefit them.

Im just wondering if Mr. Em and John Edwards are willing to sit down and discuss this like two adults and come to some kind of medium or something with of course union reps their that he can trust and get this resolved because the way it looks no matter what happens a lot of info and remarks are being made that no one will forget.

My experience at this college is telling me something.

It is so easy to blast the CSEA...but its a hard working group following the words of contract. Unfortunately, many believe the contract allows them to get their way or win every disagreement or slam their boss. The contract also does not require your boss to be a perfect human being.

These reassignments do not happen in a vacuum and I am guessing that once again the letter of the contract was followed and someone did not like the answer.

I find it also fascinating that Mr. Edwards has been apparently doing questionable acts for some time and yet....they come to light in this blog when someone is reassigned.....hmmmmmm......sounds suspicious and very self serving.

Most importantly, it brings into question everything written about Mr. Edwards in this blog.

Beyond this, it also does not sound very christian to be so self serving as to attempt to harm someone's reputation publicly and in this way when things do no your way.

Take your issues through the proper channels and get back to work.

CSEA could have prevented a lot of this. Unfortunately when EM went to CSEA he was told by one e-board member that "I will not represent you when it comes to Edwards". EM deserves good CSEA representation, it may not turn out the way he wants, but to be ignored by the union is not right.

And what happened to Chad, the groundskeeper who was let go a week before completing his probation period?...he is yet another victim of John! One Monday morning, Chad came in to find that all his equipment had been unloaded from his cart. After asking via radio who had unloaded his cart, John responded on the radio in a demanding tone of voice, "I heard you were looking for me!" After this, he drove up to Chad, kicked the cart in park, jumped off the cart while the cart hadn't even stopped, and pointed at Chad who was 5 ft away. John's face turned red as he angrily told Chad that the equipment didn't belong to him, to be quiet, quit complaining, and that the best thing for him to do is go about his business. John insisted that he himself owns the equipment. Chad was treated with such disrespect for simply asking who had moved his equipment, after all he's responsible for it...I have to question if John's hot tempered character allows him to be a sensible leader or a tyrant ruler who snaps. What a coincidence this incident happened just weeks before he was let go...

Around here, if you screw up you move up. It's been like this for years. Mr.Em is getting his 5% shift differential and the guy that rides all our female employees around campus is a supervisor now.

Has anyone had the opportunity to post that Mr. Edwards eliminated the graveyard shift at IVC for evening custodians? This was something he arranged soon after he began working in the F&M area I heard. Graveyard normally begins at 10:00 p.m. or later. The custodians at Saddleback work the graveyard shift and aren't terribly happy about their hours.

IVC custodians begin at 4:30 since I heard it seemed important to Mr. Edwards that his employees have a full life with their families.

I do not know about all this stuff that is being written but I remember thinking that this was a very kind thing for manager to do for his people.

If one person said they witnessed this one incident sometime ago and this same person spends the evening posting it nine or ten times while stating they were also a witness -- do they count as one witness or nine or ten witnesses?

It seems important to know how the rules are played in this game.

And Yes -- its a game. It just not much fun anymore. Those who find it fun should go hang out in our Child Care Center and play with some pretty crayons and draw big funny pictures to occupy yourselves.

The colors of the crayons are so pretty -- enjoy.

To 4:56 pm lives are not a game and no one on this Blog as far as I can tell believes that lives are. I was once told before and this is powerful because it to a minute to hit me. Let me see if I can say it correctly (you can speak life into some one or you can speak death to them)In other words you can lift them up or tear them down which we all are guilty of sometime. When you attack verbally it affects them somehow and because of that people will respond to it good or bad so I'm assuming that's what's happening here on the Blog its not Just Em who just Wanted a better reason than just (I'm trying something) its everyone who feels offended and hopefully for a good reason. I will say this I'm sure not everyone who makes a remark here may have a good reason but the onse who do are Probably speaking the truth.

I remember a sub custodian lady named Carla. She was getting abused verbally by her lead. Some of the comments He made to her are too vulgar to write on here. That was harrasment and she never said anything in fear of losing her job. Well, guess what? As soon as this got out to certain people she was let go. Did Mr. Edwards ever found out about this? Was the person ever reprimanded for his verbal abuse? It seems to me that certain issues are getting tossed out or over looked.

People may say well at least you have a job but what they feel to realize even if that is true swing shift affects peoples lives and according to Dr. Wayne Ward his study found out that people working Grave Yard have more heart attacks then any other shift. No ones coming to swing shift for a month their working to hard during the day putting down those who work at nite and probably doing nothing to help anybody when they get off of work (selfish people)

In defense of Anthony Rodgers I can say this that one of the reasons why we were short custodial supplies was because JE who came from AR who has no experience in ordering custodial supplies decided to tell anthony to cut his order by half. Who would know better on how much to order JE who ran AR or Anthony Rodgers who supervised Saddle Back College custodian department

The comments being made here are neither professional nor christian.

Having disagreements with your coworker and boss happen every single day and can be handled through our standard protocol and processes of the college. The truth is no one is evil and no one is a saint here and we all need to behave accordingly.

This is all becoming childish on all sides and it accomplishes nothing other than a momentary
"gotcha."

12:12 let me share something with you from what I see. It seems like JE has offended some people in different ways according to what I see some may be legitimate because people get hurt in different ways and some may be from just plain being out of control. It looks like he has said and done some things that were out of order and really he knows himself what they were. He might not be able to make everyone happy but it takes a strong person to know when they are wrong and can apologize to the people they have hurt. You want it stopped and I'm sure others do too but even though it may stop on the blog it may not stop in their hearts because wounds have been open and it will take the same person who opened it to close and heal those wounds.

This blog has provided many people with the ability to air concerns and heal. There is no doubt about this. I hope it can occur in this case.

This blog cannot screen falsehoods, half truths and the willingness of unhappy employees to forever be unhappy employees.

If healing occurs when people post visits to Burger King or a new hairdo, well ... more power to them I suppose.

It's really something, these squeaky wheels have the best job they have ever had, excellent pay, the best benefit package in job history. Nothing like the real world doing the same job for three times less pay, little to no benefits. Plus the real world workers actually have to perform, or guess what, you lose your job.

I say lets do the right thing for the tax payers, sub out the custodians and the grounds, problems solved. Oh but wait, what then would the CSEA have to do with no more squeaky wheels to stick up for.

This campus never looked so good ever. If the job is too hot for you, then get out now...
